Preview of the November/December 2009 AALA "Agricultural Law Update"

Practitioners, legal scholars, and policy makers will not want to miss the upcoming November/December 2009 issue of the American Agricultural Law Association's Agricultural Law Update.

Here is a sneak peak of the articles that will appear in the issue. First, there is an article on the jury verdicts against Bayer in favor of rice farmers. The article covers issues involved in the genetically modified rice lawsuits. This article is authored by Thomas Redick and Bryan Endres.

Second, the update will feature Neil Harl's piece on what, exactly, "excess farm losses" means with regards to provisions which place limits on the deduction amount for farm losses "where a taxpayer receives federal farm subsidies."

Elizabeth Springsteen brings readers an article entitled, "The Lacey Act--Its Impact on Aquaculture," which, as you may have guessed, discuses the potential applications of the Lacey Act to aquaculture.

Next, the topic of class action lawsuits against food manufacturers and what trends may be emerging from these suits is covered in the Update. This article is a combined effort of Judy Akenfuss and Julianna Plawecki.

Finally, Keith Alerding takes on the estate tax with his article, "No Estate Tax Certainty (Yet)." While the article addresses the 2010 repeal of the estate tax, it also covers "possible estate planning in case the estate tax is retroactively revived in 2010."

Of course, the Update also includes Drew Kershen's Agricultural Law Bibliography--4th Quarter 2009.
